Digital Millennium Copyright Act compliance and copyright infringement procedures

Overview

Research Tools Suite respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond expeditiously to claims of copyright infringement committed using our service that are reported to our designated copyright agent.

Filing a DMCA Notice

If you believe that content on our platform infringes your copyright, you may submit a DMCA takedown notice. To be effective, your notice must include the following information:

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: A description of the material that you claim is infringing and information reasonably sufficient to permit us to locate the material, including the specific URL or location where the material appears.
  3. Contact information: Your address, telephone number, and email address.
  4. Good faith statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Signature: Your physical or electronic signature.

Counter-Notification Process

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with us. To be effective, a counter-notification must include:

  1. Identification of the material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  2. Good faith statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Personal information: Your name, address, and telephone number.
  4. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which we may be found.
  5. Service acceptance: A statement that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  6. Signature: Your physical or electronic signature.

Repeat Infringer Policy

Research Tools Suite has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also limit access to the service and/or terminate accounts of users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Academic Fair Use: We recognize that academic research often involves the use of copyrighted materials under fair use provisions. However, fair use determinations are complex and fact-specific. When in doubt, seek permission from copyright holders or consult with your institution's legal counsel.

Third-Party Content

Our platform may display or provide access to content from third-party sources, including academic databases and APIs. We do not claim ownership of such content and are not responsible for copyright compliance of third-party materials. Users should verify the copyright status and licensing terms of any materials they access through our tools.

Safe Harbor Compliance

Research Tools Suite qualifies for the DMCA safe harbor provisions as a service provider. We do not monitor user content for copyright infringement but will respond promptly to valid DMCA notices and take appropriate action as required by law.

False Claims Warning: Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages. Do not make false claims.

Modifications to This Policy

We reserve the right to modify this DMCA policy at any time. Changes will be effective immediately upon posting. Your continued use of our service after any changes constitutes acceptance of the updated policy.
